Глава 27. ОБЩИЕ ПОЛОЖЕНИЯ. ВИДЫ ТАМОЖЕННЫХ ПЛАТЕЖЕЙ Статья 318. Таможенные платежи и их виды 1.К таможенным платежам относятся: 1) ввозная таможенная пошлина; 2) вывозная таможенная пошлина; 3) налог на добавленную стоимость, взимаемый при ввозе товаров на таможенную территорию Российской Федерации; 4) акциз, взимаемый при ввозе товаров на таможенную территорию Российской Федерации; 5) таможенные сборы. 2. Таможенные платеживзимаются, если они установлены в соответствии с законодательством Российской Федерации. 3. Специальные, антидемпинговые и компенсационные пошлины, устанавливаемые в соответствии с законодательством Российской Федерации о специальных защитных, антидемпинговых и компенсационных мерах при импорте товаров, взимаются по правилам, предусмотренным настоящим Кодексом для взимания ввозной таможенной пошлины. Статья 319. Возникновение и прекращение обязанности по уплате таможенных пошлин, налогов. 1. При перемещении товаров через таможенную границу обязанность по уплате таможенных пошлин, налогов возникает:   1) при ввозе товаров - с момента пересечения таможенной границы;   2) при вывозе товаров - с момента подачи таможенной декларации или совершения действий, непосредственно направленных на вывоз товаров с таможенной территории Российской Федерации. 2. Таможенные пошлины, налоги не уплачиваются в случае, если: 1) в соответствии с законодательством Российской Федерации или настоящим Кодексом: · товары не облагаются таможенными пошлинами, налогами; · в отношении товаров предоставлено условное полное освобождение от уплаты таможенных пошлин, налогов, - в период действия такого освобождения и при соблюдении условий, в связи с которыми предоставлено такое освобождение;     2) общая таможенная стоимость товаров, ввозимых на таможенную территорию Российской Федерации в течение одной недели в адрес одного получателя, не превышает 5000 рублей; 3) до выпуска товаров для свободного обращения и при отсутствии нарушений лицами требований и условий, установленных настоящим Кодексом, иностранные товары оказались уничтоженными или безвозвратно утерянными вследствие аварии или действия непреодолимой силы либо в результате естественного износа или убыли при нормальных условиях транспортировки, хранения или использования (эксплуатации); 4) товары обращаются в федеральную собственность в соответствии с настоящим Кодексом и другими федеральными законами. 3. В отношении товаров, выпущенных для свободного обращения на таможенной территории Российской Федерации либо вывезенных с этой территории, обязанность по уплате таможенных пошлин, налогов прекращается в случаях, предусмотренных Налоговым кодексом Российской Федерации. Статья 320. Лица, ответственные за уплату таможенных пошлин, налогов 1. Лицом, ответственным за уплату таможенных пошлин, налогов, является декларант. Если декларирование производится таможенным брокером (представителем), он является ответственным за уплату таможенных пошлин, налогов в соответствии с пунктом 2 статьи 144 настоящего Кодекса. 2. При несоблюдении положений настоящего Кодекса о пользовании и распоряжении товарами или о выполнении иных требований и условий, установленных настоящим Кодексом для применения таможенных процедур и таможенных режимов, содержание которых предусматривает полное или частичное освобождение от уплаты таможенных пошлин, налогов, лицами, ответственными за уплату таможенных пошлин, налогов в случаях, прямо предусмотренных настоящим Кодексом, являются владелец склада временного хранения, владелец таможенного склада, перевозчик, лица, на которые возложена обязанность по соблюдению таможенного режима. 3. При неуплате таможенных пошлин, налогов, в том числе при неправильном их исчислении и (или) несвоевременной уплате, ответственность перед таможенными органами несет лицо, ответственное за уплату таможенных пошлин, налогов. 4. При незаконном перемещении товаров и транспортных средств через таможенную границу ответственность за уплату таможенных пошлин, налогов несут лица, незаконно перемещающие товары и транспортные средства, лица, участвующие в незаконном перемещении, если они знали или должны были знать о незаконности такого перемещения, а при ввозе - также лица, которые приобрели в собственность или во владение незаконно ввезенные товары и транспортные средства, если в момент приобретения они знали или должны были знать о незаконности ввоза, что надлежащим образом подтверждено в порядке, установленном законодательством Российской Федерации.     Глава 28. ИСЧИСЛЕНИЕ ТАМОЖЕННЫХ ПОШЛИН, НАЛОГОВ Статья 322. Объект обложения таможенными пошлинами, налогами Объектом обложения таможенными пошлинами, налогами являются товары, перемещаемые через таможенную границу. Налоговой базой для целей исчисления таможенных пошлин, налогов являются таможенная стоимость товаров и (или) их количество. Статья 323. Порядок определения и заявления таможенной стоимости товаров   1. Таможенная стоимость товаров определяется декларантом согласно методам определения таможенной стоимости, установленным законодательством Российской Федерации, и заявляется в таможенный орган при декларировании товаров. 2. Заявляемая декларантом таможенная стоимость товаров и представляемые им сведения, относящиеся к ее определению, должны основываться на достоверной и документально подтвержденной информации.   3. Контроль таможенной стоимости товаров осуществляется таможенными органами в порядке, определяемом федеральным министерством, уполномоченным в области таможенного дела, в соответствии с настоящим Кодексом. Таможенный орган на основании документов и сведений, представленных декларантом, а также на основании имеющейся в его распоряжении информации, используемой при определении таможенной стоимости товаров, принимает решение о согласии с избранным декларантом методом определения таможенной стоимости товаров и о правильности определения заявленной декларантом таможенной стоимости товаров. 4. Если представленные декларантом документы и сведения не являются достаточными для принятия решения в отношении заявленной таможенной стоимости товаров, таможенный орган в письменной форме запрашивает у декларанта дополнительные документы и сведения и устанавливает срок для их представления, который должен быть достаточен для этого.   Для подтверждения заявленной таможенной стоимости товаров декларант обязан по требованию таможенного органа представить необходимые дополнительные документы и сведения либо дать в письменной форме объяснение причин, по которым запрашиваемые таможенным органом документы и сведения не могут быть представлены. Декларант имеет право доказать правомерность использования избранного им метода определения таможенной стоимости товаров и достоверность представленных им сведений.   5. При отсутствии данных, подтверждающих правильность определения заявленной декларантом таможенной стоимости товаров, либо при обнаружении признаков того, что представленные декларантом документы и сведения не являются достоверными и (или) достаточными, таможенный орган вправе принять решение о несогласии с использованием избранного метода определения таможенной стоимости товаров и предложить декларанту определить таможенную стоимость товаров с использованием другого метода. В указанном случае между таможенным органом и декларантом могут проводиться консультации по выбору метода определения таможенной стоимости товаров. 6. Если в сроки выпуска товаров (статья 152) процедура определения таможенной стоимости товаров не завершена, выпуск производится при условии обеспечения уплаты таможенных платежей, которые могут быть дополнительно начислены. Таможенный орган в письменной форме сообщает декларанту размер требуемого обеспечения уплаты таможенных платежей.   Дополнительное обеспечение уплаты вывозных таможенных пошлин, налогов не предоставляется в случае экспорта биржевых товаров, цена реализации которых на момент таможенного оформления неизвестна. 7. В случаях, когда декларантом не представлены в установленные таможенным органом сроки дополнительные документы и сведения либо таможенным органом обнаружены признаки того, что представленные декларантом сведения могут не являться достоверными и (или) достаточными, и при этом декларант отказался определить таможенную стоимость товаров на основе другого метода по предложению таможенного органа, таможенный орган самостоятельно определяет таможенную стоимость товаров, последовательно применяя методы определения таможенной стоимости товаров. Таможенный орган уведомляет декларанта о принятом решении в письменной форме не позднее дня, следующего за днем принятия такого решения. В случае, когда таможенный орган определяет таможенную стоимость товаров после выпуска товаров, таможенный орган выставляет требование об уплате таможенных платежей (статья 350), если требуется доплата таможенных пошлин, налогов. Уплата дополнительно исчисленных сумм таможенных пошлин, налогов должна быть осуществлена в течение 10 рабочих дней со дня получения требования. Пени на дополнительную сумму таможенных пошлин, налогов, уплаченную в течение указанного срока, не начисляются.   Статья 324. Порядок исчисления таможенных пошлин, налогов 1. Таможенные пошлины, налоги исчисляются декларантом или иными лицами, ответственными за уплату таможенных пошлин, налогов, самостоятельно, за исключением случаев, предусмотренных пунктом 3 статьи 295 настоящего Кодекса и пунктом 2 настоящей статьи. 2. При выставлении требования об уплате таможенных платежей в соответствии со статьей 350 настоящего Кодекса исчисление подлежащих уплате таможенных пошлин, налогов производится таможенным органом. 3. Исчисление сумм подлежащих уплате таможенных пошлин, налогов производится в валюте Российской Федерации.   Статья 325. Применение ставок таможенных пошлин, налогов 1. Для целей исчисления таможенных пошлин, налогов применяются ставки, действующие на день принятия таможенной декларации таможенным органом, за исключением случаев, предусмотренных статьями 150, 312 и пунктом 1 статьи 327 настоящего Кодекса. 2. Для целей исчисления таможенных пошлин, налогов применяются ставки, соответствующие наименованию и классификации товаров в соответствии с Таможенным тарифом Российской Федерации и Налоговым кодексом Российской Федерации, за исключением случаев, предусмотренных абзацем вторым настоящего пункта, а также предусмотренных статьей 282 настоящего Кодекса при применении единых ставок таможенных пошлин, налогов к товарам, перемещаемым через таможенную границу физическими лицами для личного пользования. 3. При декларировании товаров нескольких наименований с указанием одного классификационного кода по Товарной номенклатуре внешнеэкономической деятельности в соответствии со статьей 128 настоящего Кодекса в отношении всех таких товаров применяются ставки таможенных пошлин, налогов, соответствующие этому классификационному коду.   Глава 29. ПОРЯДОК И СРОКИ УПЛАТЫ ТАМОЖЕННЫХ ПОШЛИН, НАЛОГОВ Статья 328. Плательщики таможенных пошлин, налогов 1. Плательщиками таможенных пошлин, налогов являются декларанты и иные лица, на которых настоящим Кодексом возложена обязанность уплачивать таможенные пошлины, налоги. 2. Любое лицо вправе уплатить таможенные пошлины, налоги за товары, перемещаемые через таможенную границу. Статья 329. Сроки уплаты таможенных пошлин, налогов 1. При ввозе товаров таможенные пошлины, налоги должны быть уплачены не позднее 15 дней со дня предъявления товаров в таможенный орган в месте их прибытия на таможенную территорию Российской Федерации или со дня завершения внутреннего таможенного транзита, если декларирование товаров производится не в месте их прибытия.     2. При вывозе товаров таможенные пошлины должны быть уплачены не позднее дня подачи таможенной декларации, если иное не установлено настоящим Кодексом.   3. При изменении таможенного режима таможенные пошлины, налоги должны быть уплачены не позднее дня, установленного настоящим Кодексом для завершения действия изменяемого таможенного режима.   4. При использовании условно выпущенных товаров в иных целях, чем те, в связи с которыми были предоставлены таможенные льготы, для целей исчисления пеней (статья 349) сроком уплаты таможенных пошлин, налогов считается первый день, когда лицом были нарушены ограничения на пользование и распоряжение товарами. Если такой день установить невозможно, сроком уплаты таможенных пошлин, налогов считается день принятия таможенным органом таможенной декларации на такие товары.   5. При нарушении требований и условий таможенных процедур, которое, в соответствии с настоящим Кодексом влечет обязанность уплатить таможенные пошлины, налоги, сроком уплаты таможенных платежей для целей исчисления пеней считается день совершения такого нарушения. Если такой день установить невозможно, сроком уплаты таможенных пошлин, налогов считается день начала действия соответствующей таможенной процедуры.   6. Сроки уплаты таможенных платежей в отношении товаров, перемещаемых физическими лицами для личного пользования, в международных почтовых отправлениях, трубопроводным транспортом и по линиям электропередачи, временно ввезенных товаров с частичным освобождением от уплаты таможенных пошлин, налогов, незаконно ввезенных товаров, обнаруженных у их приобретателей (организаций, осуществляющих оптовую или розничную продажу ввезенных товаров) на территории Российской Федерации, определяются настоящим Кодексом. Chapter 27. GENERAL PROVISIONS. CUSTOMS PAYMENTS Article 318. Customs Payments and their Categories 1.Customs payments include: 1) import duties; 2) export duties; 3) value-added tax levied on the goods imported to the customs territory of the Russian Federation; 4) excise tax levied on the goods imported to the customs territory of the Russian Federation; 5) customs fees. 2. Customs duties shall be levied in those instances stipulated by the law of the Russian Federation. 3. Special antidumping and compensational duties stipulated by the Federal Law on Measures for Protecting Economic Interests of the Russian Federation in Foreign Trade Operations with Goods and Commodities are levied in accordance with this Customs Code with regard to import duties.   Article 319. Commencement and Termination of Responsibility with regard to Payment of Customs Duties and Taxes. 1. Responsibility for the payment of customs duties and taxes on the goods conveyed across the customs border shall commence: 1) in the instance of importation, from the moment of goods crossing the customs border; 2) in the instance of exportation, from the moment of submission of a customs declaration or other activities with a direct intent to export goods from the customs territory of the Russian Federation. 2. Customs duties and taxes shall not be levied on goods, provided: 1) in accordance with law of the Russian Federation or this Customs Code:   · the goods are exempt from customs duties and taxes; · the goods have been accorded complete conditional exemption from customs duties and taxes. Customs duties and taxes shall not be levied on such goods throughout the period of validity of said exemption provided the terms and conditions stipulating said exemption are observed. 2) the overall customs value of the goods imported to the customs territory of the Russian Federation within a single week addressed to the same recipient does not exceed 5,000.00 roubles; 3) prior to the goods release for free circulation and in the absence of any violations by persons of the terms and conditions stipulated by this Customs Code, foreign goods were destroyed or irretrievably lost as a result of an accident or force majeure, or as a result of their natural wear or diminution under normal conditions of their haulage, storage and utilization (operation);   4) goods are converted to federal property in accordance with this Customs Code and other federal statutes.   3. Responsibility for disbursement of customs duties and taxes for the goods released for free circulation in the customs territory of the Russian Federation or exported from said territory is terminated in the instances stipulated by the Tax Code of the Russian Federation. Article 320. Persons Responsible for Customs Payments 1. Responsibility for the disbursement of customs duties and taxes shall be vested in the declarant. In case the goods are declared by a customs broker (agent), the latter shall be responsible for the disbursement of all dutiable payments as per Item 2 of Article 144 of this Customs Code.   2. In the instance of non-observance of the provisions stipulated by this Customs Code with regard to the use and disposal or goods, or observance of other terms and conditions stipulated by this Customs Code with regard to the application of customs procedures envisaging partial or compete exemption of goods from customs duties and taxes, responsibility for the disbursement of customs duties and taxes in the instances, which are directly stipulated by this Customs Code, shall be the owner of a temporary-storage warehouse, the owner of a bonded warehouse, the carrier, the persons obliged to ensure the observance of the terms and conditions of specific customs procedures. 3. In the instance of non-payment of customs duties and taxes, as well as in case of their incorrect calculation and/or delayed payment, the person responsible for the payment of customs duties and taxes shall be answerable to the customs authorities. 4. In case of the illegal exportation of goods and means of transport across the customs border, jointly responsible for the payment of customs duties and taxes levied on to goods and means of transport shall be the persons who have illegally conveyed the goods and means of transport across the border, as well as the persons who have participated in said conveyance if they were aware or were supposed to be aware of the illegal nature of said conveyance; in the instance of illegal importation, responsible for the payment of customs duties and taxes levied on to goods and means of transport shall be the persons who have owned or come in possession of the illegally imported goods and means of transport if at the time of the purchasing transaction they were aware, or were supposed to be aware of the illegal nature of said importation, which fact was duly certified by the procedures stipulated by law of the Russian Federation.   Chapter 28. CALCULATION OF CUSTOMS DUTIES AND TAXES Article 322. Subject to Customs Duties, Taxes Subject to customs duties and taxes shall be the goods conveyed across the customs border defined by the Russian legislation on taxes and duties and by this Code. The taxable basis of customs duties and taxes comprises the goods customs value and/or their quantity. Article 323. General Provisions for Defining and Declaring Goods Customs Value 1. The goods customs value is determined by the declarant in accordance with the methods of appraising customs value approved by law of the Russian Federation; the customs value determined thereby shall be stated to customs authorities at the instance of goods declaration. 2. The customs value stated by the declarant and the factual details used for appraising the goods customs value furnished by the declarant ought to be based on authentic documentarily certified information. 3. The customs authorities verify the goods declared customs value based on the procedures approved by the Federal Customs Authority pursuant to the provisions on this Customs Code.   Based on the documents and details furnished by the declarant and with consideration of the reference information at the disposal of said customs office which is used for appraising the goods customs value, the customs authorities will evaluate the method chosen by the declarant for appraising the goods customs value, as well as the accuracy of the goods customs value stated by the declarant. 4. In case the customs authorities deem insufficient the documents and information furnished by declarant for passing a resolution with regard to the stated goods customs value, the customs office concerned makes a written request to the declarant asking him (or her) to provide additional documents and details pertaining to said goods, and designate the time limit for their submission. In order to prove the correctness of the stated goods value, the declarant should be obliged, on the request issued by the customs authorities, to furnish all the necessary additional documents and details or submit a formal written explanation stating the reasons preventing him (or her) from furnishing to the customs authorities the required documents and details. The declarant has the right to substantiate the correctness of the selected method of appraising the goods customs value and prove the authenticity of the information furnished to the customs authorities. 5. In the absence of facts proving the correctness of the goods customs value stated by the declarant or when the customs authorities have discovered evidence that the documents and the information submitted by the declarant are inauthentic or insufficient, the customs office has the right to take a decision to disapprove of the method chosen by the declarant for appraising the goods customs value and recommend that the declarant apply a different method for appraising the goods customs value. In this situation, the customs authorities and the declarant may hold consultations with regard to the method applicable for appraising the goods customs value. 6. If the goods customs value has not been determined within the time terms prescribed for the goods release (Article 152), said goods will be released against the declarant’s guarantee to disburse the dutiable payments that may be additionally levied on said goods. The customs office issues a written notification to the declarant informing him (or her) of the required guarantee of dutiable payments. No additional guarantee of dutiable payments will be required in the instance of exported stock-exchange commodities whose sale price remains unknown on the date of customs registration formalities. 7. In case the declarant failed to present requisite additional facts and documents requested by the customs authorities within the time limits prescribed by the customs office, or if the customs authorities have discovered evidence that the documents and the information submitted by the declarant are not authentic and/or sufficient, or if the declarant refused to determine the goods customs value by using another method recommended by the customs authorities, the customs office will determines the goods customs value on its own by way of consecutive application of the available methods of appraising goods customs value. The customs office shall be obliged to inform the declarant in writing of the decision taken with regard to the goods customs value not later than on the day following the day when said decision is made. In the instance when the customs office has determined the goods customs value following the goods release, the customs authorities will issue an invoice for customs payments (Article 350) in case additional redemption of customs duties and taxes is required. Settlement of the additionally charged amounts of customs duties and taxes should be completed within ten working days from the day when said invoice is received. If the additional amounts of customs duties and taxes are settled within the prescribed time limits, they shall be exempt from any penalty fees. Article 324. Customs Duties and Taxes Calculation Procedure 1. Customs duties and taxes are calculated by the declarant or the other persons responsible for dutiable payments independently, except the instances stipulated by Item 3 of Article 295 of this Customs Code and Item 2 herein.     2. When an invoice for dutiable payments is issued as per Article 350 of this Customs Code, calculation of the customs duties and taxes is effected by the customs office concerned. 3. Calculations of the payable amounts of customs duties and taxes shall be made in using the legal tender of the Russian Federation. Article 325. Application of Rates of Customs Duties and Taxes 1. Customs duties and taxes are calculated based on the rates effective on the day of acceptance by the customs authorities of the customs declaration, except the instance stipulated by Articles 150, 312, and Item 1 of Article 327 of this Customs Code.   2. Calculation of customs duties and taxes are based on the rates corresponding to the name and classification code of the goods and commodities stipulated by the Customs Tariff of the Russian Federation and the Tax Code of the Russian Federation, except the instances stipulated by the second paragraph herein, as well as the instances stipulated by Article 282 of this Customs Code pertaining to the application of general rates of customs duties and taxes to the goods conveyed across the customs border by natural persons for their personal use.   3. In the instance of declaring several names of goods under the same classification code, as per the Nomenclature of Goods subject to Foreign Trade, as per Article 128 of this Customs Code, such goods shall be liable for the customs duties and taxes corresponding to this classification code.   Chapter 29. PAYMENTS OF CUSTOMS DUTIES. TERMS AND PROCEDURES Article 328. Payers of Customs Duties and Taxes 1. Payers of customs duties and taxes may be goods declarants and any other persons responsible for disbursement of customs duties and taxes pursuant to this Customs Code. 2. Every person has the right to pay customs duties and taxes levied on the goods conveyed across the customs border. Article 329. Terms of Payments of Customs Duties and Taxes 1. In the instance of goods importation, import duties and taxes should be disbursed not later than within fifteen days from the day said goods were presented to the customs authorities for inspection at the point of entry to the customs territory of the Russian Federation or within fifteen days from the day of completion of the goods domestic customs transit procedure in case goods were not declared at their point of entry. 2. In the instance of goods exportation, export duties and taxes should be disbursed not later than on the day of submission of a customs declaration unless this Customs Code contains other provisions hereto. 3. In the instance of change of the goods customs procedure, customs duties and taxes should be disbursed not later than on the day stipulated by this Customs Code for the completion of the changed customs procedure. 4. In case conditionally released goods are used for the purposes other than those stated as the reason for the customs privileges and exemptions for the purpose of calculation of requisite penalty fees (Article 349) the date of disbursement of the customs duties and taxes shall be the first day when the person responsible for said goods breached the restrictions stipulating the goods use and disposal. In case such date cannot be established, the date of payment of customs duties and taxes shall be the day of acceptance by the customs authorities of the customs declaration pertaining to said goods. 5. In case of violation of the terms and conditions stipulated by specific customs procedures applied to the goods, which violation pursuant to this Customs Code entails the declarant’s responsibility for payment of customs duties and taxes, the date of disbursement of the customs duties and taxes for the purpose of calculation of requisite penalty fees shall be the day when said terms and conditions were breached. In case such date cannot be established, the date of payment of customs duties and taxes shall be the day of commencement of the respective customs procedure. 6. This Customs Code stipulates the terms of payment of customs duties and taxes levied on the goods conveyed across the customs border by natural persons for personal use, on the goods dispatched by international mail, on the commodities conveyed through pipeline transport and electric power lines, on the goods imported with partial conditional exemption from customs duties and taxes, and on the illegally imported goods and commodities discovered in possession of their buyers (organisations involved in wholesale and retail sale operations with imported goods and commodities) in the territory of the Russian Federation.
