Передмова

Запропонований посібник розрахований на магістрів, а також на юристів, які бажають поповнити свої знання з англійської мови.

Мета посібника навчити магістрівспілкуватися іноземною мовою, щоб:

Ø обговорювати зі співрозмовником пов’язані зі спеціалізацією питання;

Ø готувати публічні виступи з питань своєї спеціалізації, застосовуючи відповідні засоби вербальної комунікації та адекватні форми ведення дискусій;

Ø знаходити нову текстову, графічну, аудіо- та відеоінформацію, що міститься в матеріалах іноземною мовою (як у друкованому, так і в електронному вигляді), користуючись відповідною термінологією;

Ø писати іноземною мовою анотацію (резюме) тексту/статті.

Зміст екзамену

 

1. Написання іноземною мовою анотації до україномовної наукової статті з фаху (робота зі словником). Обсяг тексту 2500 друкованих знаків. Час на підготовку 35 хвилин.

Перевіряються навички та уміння ознайомлювального читання та письмового викладення іноземною мовою короткого змісту прочитаного.

2. Бесіда іноземною мовою з викладачем на запропоновану ситуацію в межах теми «На міжнародній конференції». Обсяг висловлювання 10-12 фраз.

Перевіряються навички та уміння усного мовлення як спонтанного так і підготовленого.

World of Rules

A rule is a guideline for behavior. It is meant to manage the way a person acts or does something. For example, there are rules in the game of baseball. These rules tell baseball player how to play the game of baseball. They tell the players what they can and cannot do. Rules may be written or unwritten. They may also be started by habit or custom. For example, it is a rule in my house that we must eat dinner, at the table, together. We cannot watch television while eating. This is a family custom or habit.

Good rules are helpful, and bad rules are sometimes confusing. For example, ‘Do not run in the swimming pool area’ is a good rule because it protects people from getting hurt. ‘Be friends with everyone in class’ is not a good rule because it is not reasonable to order friendships. How will a teacher know if students are actually friends? Also, should there be a punishment for people who are not friends? What makes these rules good or bad?

A.Rules should be clear and easy to understand. B. People should be able to do what the rules say. C. Rules should not conflict with other rules. D. Rules should be enforceable. E. There should be a penalty for breaking rules.

 

Many places in your community have rules. In shopping malls, for example, people are not allowed to run or play loud radio music. What is the purpose of these rules? Can you think of other places where there are rules? What are some other rules?

Laws are rules which are set and enforced by a government. They protect people and help people get along with each other. Laws are written by the government for the entire community. They are out in a code or law book. Every town or city has laws. Imagine what community would be like without laws. What might happen in a community where there are no laws?

Реферат і анотація

Реферат -це стислий виклад основного змісту первинного документу. Інформативність є найбільш суттєвою і визначальною ознакою реферату.

Реферат складається з таких структурних елементів:

Ø Заголовок (назва реферату)

Ø Зміст (розділи і сторінки)

Ø Висновки

Ø Бібліографія

Ø Виконавець

Обсяг реферату

На сьогодні не існує єдиної точки зору щодо обсягу реферату. Він:

· повинен відповідати значенню і характеру реферованої роботи;

· залежить від цільової настанови: для кого і з якою метою виконується дана робота;

· реферат-конспект не має перевищувати 1/5 частини тексту оригіналу;

· реферат-резюме за обсягом повинен бути не більшим від 1/10 частини оригіналу.

 

Складання рефератів

 

Першим етапом роботи по реферуванню є уважне читання всього тексту‚ поділ його на змістові фрагменти‚ визначення теми і головної думки (ідеї) тексту.

При поділі тесту на змістові фрагменти вагому допомогу може надати наявність абзаців.

Другим етапом є визначення логічної структури тексту і перегрупування виділених у тексті або вписаних фрагментів згідно цієї логічної структури.

Третім етапом є складання тексту самого реферату. Досить часто текст реферату монтажується з частинок тексту оригіналу. Але необхідно пам’ятати‚ що реферат це новий текст.

Четвертим і завершальним етапом у роботі над рефератом є його редагування.

Для забезпечення логічної цільності тексту до реферату вводяться специфічні вирази типу:

Зазначається (зазначено)... It is noted... Було визначено... It was defined... Аналізується... It is analyzed...

Крім того використовуються і спеціальні кліше, що подають загальну оцінку змісту:

Перекладацьке реферування

Перекладацьке реферування тексту, який написаний іноземною мовою відрізняється від звичайного реферування лише тим‚ що перекладацьке реферування виконується українською мовою.

Якщо перекладач відновлює в рефераті іноземний термін‚ у якого немає еквіваленту в українській мові‚ або якщо він не впевнений у тому‚ що йому взагалі вдалося розкрити значення незнайомого для нього іноземного терміну за допомогою перекладу‚ він зобов’язаний вказати цей іноземний термін в дужках відразу після його українського еквіваленту.

Анотація - являє собою скорочений виклад головного змісту першоджерела (статті, книги тощо). Середній розмір анотації: 30-40 слів, або 3-4 речення.

Науковий стиль – це стиль наукової прози. Мова наукового стилю використовується для написання наукових статей, анотацій, рефератів, доповідей та має за мету доводити гіпотези, створювати нові концепції, розкривати внутрішні закони існування, розвитку, відносини між різними явищами.

У доповідях широко використовується загальнонаукова лексика та загальноприйняті скорочення, а також спеціальна термінологія за тематикою дослідження. У тексті доповіді можуть бути використані такі опорні слова наукового опису:

Об'єктивне право

Пра́во (право в об'єктивному розумінні) — система встановлених та охоронюваних державою загальнообов'язкових, формально визначених норм (правил), що врегульовують найважливіші суспільні відносини. Вони мають повноваження визнавати правомірними чи неправомірними певні діяння (дії або бездіяльність), дозволяють або забороняють певні відносини між людьми і об'єднаннями, забезпечують методи гарантування справедливих відносин, прав і свобод людей і їхніх об'єднань, і забезпечують відповідальність і покарання для тих, хто не дотримується встановлених правил поведінки. Право не регулює питання етики, моралі, норми пристойності і т.п. Все це передбачено в морально-етичних, релігійних та естетичних нормах. Але в окремих випадках правові норми передбачають відповідальність і покарання за порушення цих правил і визначає ці норми в законодавчому порядку.

У розвинутих суспільствах право пов'язане з державою і не може існувати окремо від нього, оскільки його загальнообов'язковість забезпечується заходами державного впливу, а самі норми як правило приймаються, змінюються або скасовуються тільки державними органами. У суспільствах, де державна влада відсутня чи її вплив дуже слабкий, правові взаємини можуть регулюватися встановленими традиціями, релігією.

У свою чергу держава не може існувати без права, тому що нормами права регулюються державний лад, а це форма правління держави, її територіальний устрій, політичний режим. А також організація і порядок діяльності державних органів, міри покарання за невиконання обов'язкових указівок держави, а також інші суспільні відносини, важливі для існування держави.

The Birth of Law

Laws and rules – and the customs and conventions – from which they are descended have always been the part of human life ever since our ancestors first began to live in large and settled groups. But our knowledge is vague of laws that were in effect before the invention of writing in about 3500 B.C. The earliest known legal text was written by Ur-Nammu, a king of the Mesopotamian city of Ur, in about 2100 B.C. It dealt largely with compensation for bodily injuries, penalties for witchcraft and runaway slaves.

One of the earliest known collections of codified laws is the Code of Hammurabi. Hammurabi was a king of Babylon from 1728 B.C. to 1686 B.C. So that everyone could know the laws, the laws were carved into the stone pillars set up in the temple to the Babylonian god Marduk. The laws covered crime, divorce, marriage, the rights of slave owners and slaves, the settlement of debts, inheritance and property contracts; there were even regulations about taxes and the prices of goods. Punishments under the code were harsh. The cruel principle of revenge was observed: an eye for an eye and a tooth for a tooth, which meant that the punishment had to correspond to those damages and injuries that criminals had inflicted upon their victims. Not only murderers but also thieves and false accusers faced the death penalty. The code outlawed private blood feuds and banned the tradition by which a man could kidnap and keep the woman he wanted for his bride. In addition, the new laws took account of the circumstances of the offender as well as the offence. So lower-ranking citizen who lost a civil case would be fined less than an aristocrat in the same position – though he would also be awarded less if he won.

Another code of early law is the Code of Hebraic, or Mosaic Law of about 1400 B.C. This code set out in detail in the first five books of the Old Testament, which are called the Torah, meaning ‘law’ or ‘guidance’ These books recount the forty-year-long wandering of Moses and the tribes of Israel from Egypt across the Sinai desert to the Promised Land of Canaan. While in the desert, Moses was summoned to the top of Mount Sinai by God and was given the tablets of Ten Commandments. Like the Babylonians, the Hebrew compilers believed that their laws were based on the will of God. Unlike the commercially-oriented Code of Hammurabi, the Mosaic Law reflects the agrarian community which Moses presided over. As chief lawgiver and magistrate, Moses was both a legislator and a judge in the modern sense. The Ten Commandments still hold a central position today in the teaching of both the Hebrew and the Christian faiths. As well, the Mosaic Law forms an important part of the laws of many countries today.

The Sources of English Law

At the heart of the English system there are two principles of government – limited government and representative government. The idea that government was not all-powerful first appeared in the Magna Carta, or Great Charter, that King John signed in 1215 under the threat of civil war.

The Magna Carta established the principle of limited government, in which the power of the monarch, or government, was limited, not absolute. This document provided for protection against unjust punishment and loss of life, liberty, and property except according to law. It stipulated that no citizen could be punished or kept in prison without a fair trial. Under the Magna Carta, the king agreed that certain taxes could not be levied without popular consent. The Magna Carta came in time to be regarded as a cornerstone of British liberties. It is one of the oldest written constitutional papers.

In Britain, the United States, and many other English-speaking countries, the law of Habeas Corpus guarantees that nobody can be held in prison without trial. Habeas Corpus became a law because of a wild party held in 1621 at the London home of a notoriously rowdy woman, Alice Robinson.

When a constable appeared and asked her and her guests to quiet down, Mrs. Robinson swore at him so violently that he arrested her, and a local justice of the peace committed her to jail. When she was brought to trial, Mrs. Robinson’s story of her treatment in prison caused an outcry. Such treatment was barbaric even by the harsh standards of the time. Public anger was so great that she was acquitted, the constable who had arrested her without the warrant was himself sent to prison, and the justice of the peace was severely reprimanded. And the case led to the passing of the Habeas Corpus Act in Britain in 1679. The law is still on the British statute books. Habeas Corpus is part of a Latin phrase – Habeas Corpus ad subjiciendum - that means ‘Let the body be brought before the judge,’ In effect, a writ of Habeas Corpus is an order in the name of the people (or, in Britain, of the sovereign) to produce an imprisoned person in court at once.

The Bill of Rights (1689) is one of the basic instruments of the British constitution, the result of the long 17th century struggle between the Stuart kings and the English people and Parliament. The revolution settlement made monarchy conditional on the will of Parliament and provided a freedom from arbitrary government of which most Englishmen were notably proud during the 18th century. The main purpose of the act was unequivocally to declare illegal various practices of James II. Among such practices proscribed were the royal prerogatives of dispensing with the law in certain cases, the complete suspension of laws without the consent of Parliament, and the levying of taxes and the maintenance of a standing army in peacetime without specific parliamentary authorization. A number of clauses sought to eliminate royal interference in parliamentary matters, stressing that elections must be free and that members of Parliament must have complete freedom of speech. Certain forms of interference of the course of justice were also proscribed. The act also dealt with proximate succession to the throne, provided the heirs were Protestants. It is the constitutional paper of great importance, which prevented the sovereign from abusing his authority.

The laws of much continental Europe owe their modern form largely to a man who never studied law. Napoleon Bonaparte established in 1800 five commissions to refine and organize the diverse legal systems of France. The resulting Code was a triumphant attempt to create a legal system that treated all citizens as equals without regard to their rank or previous privileges. It was also so clearly written that it could be read and understood by ordinary people. The code was adopted intact in most of the areas of Europe and spread from there across the Atlantic. Many of its principles are still in force.

Боротьба монарха та парламенту призвела до революції під назвою «Славна революція» («Glorious Revolution») 1688 року. Король Яків ІІ був повалений (overthrow), і йому довелося залишити країну. Його підозрювали (suspect of) у бажанні зробити католицьку релігію офіційною релігією в Англії.

За актом про спадкування престолу (Act of Settlement), опублікованим після Славної революції, принц Вільгельм Оранський (William of Orange) та його дружина Марія успадкували трон. Умовою їх коронації було прийняття ними англійського Біля про Права(Bill of Rights). Англійський Біль про Права обмежував владу монарха, наділяючи (vest with) парламент вирішальною владою, і забезпечував захист англіканської церкви від будь-яких спроб релігійної контр-реформи Якова ІІ чи його спадкоємців. Англійський Біль про Права передбачав багато ідей, що стосувалися держави та права, які згодом були відображені в американській Декларації про незалежність, Конституції та Білі про Права. Constitutional Law

Constitutional law establishes the political and state system, rights, freedoms and duties of citizens, legal status of the Verkhovna Rada, the president, the Cabinet of Ministers, other bodies of state executive power and of local authorities, the justice system, territorial structure, state symbols, etc. The main source of constitutional law is the Constitution of Ukraine.

Civil Law

Civil law includes the legal rules governing the ownership and non-property relations, as well as personal relations between the objects of public relations in order to satisfy their demands. The main act in this branch is the Civil Code of Ukraine which entered in force on December 1, 2004. It contains six books and sets basically a new (for Ukraine) system of norms to govern civil relations. Taking into account new constitutional approaches to the human being and its inalienable rights it fixes individual non-property rights of a person and governs relations which enforce these rights. This code introduces new types of agreements into the legal practice: factoring, franchising, and rent service or inherited contracts etc.

Labour Law

Labour Law includes the legal rules collected in the Labour Code and governs the relations as to the labour contracts, working time and conditions, safety at the working place, social protection, the order of labour disputes resolution, etc.

Matrimonial Law

Matrimonial law relates to the grounds of marriage, its solemnization and dissolution, personal ownership and non-property rights and duties of the spouses, relations between parents and children, adoption issues, etc. Such rules are incorporated into the Family Code which was adopted on January 10, 2002 and came in force on January 1, 2003.

Financial Law

Financial lawregulates the state budget, banking, tax system, etc and its object of regulation is money and securities. The formation of financial system of Ukraine is in progress. In 2001 the Budget Code was adopted on June 21, 2001 and came in force on June, 2001.

Land Law
