Говоря о регионах, в которых активизация деятельности ЕБРР была бы крайне желательна, хотелось бы отметить Калининградскую область. Калининградская область представляет собой крайне благоприятный полигон¹ для отработки перспективных форм и методов привлечения иностранного капитала, что, в частности, обусловлено принятым в конце января 1996 года Законом «Об особой экономической зоне в Калининградской области»² и специальным Указом Президента³ России по Калининградской свободной экономической зоне. В Калининградской области может сформироваться международный финансовый центр подобно оффшорным центрам в других частях земного шара.

 

Разработка и реализация с участием Российских структур межрегиональных и межгосударственных программ представляет особую важность. Речь идет о становлении новой, более рациональной системы торговли в рамках СНГ по линии поставок сырья, минеральных удобрений, комплектующих⁴ и запасных частей. Реальное продвижение по многим из указанных направлений, безусловно, потребует усилий не только Европейского банка, но и других международных финансово-банковских институтов, которые принимают участие в этом семинаре⁵. Мы уверены, что практическое взаимодействие и координация усилий ЕБРР с МБРР, ЕЭС, МВФ в рамках указанного выше⁶ принесет практические результаты как для России, так и для самих многосторонних институтов и их акционеров.

Мы считаем, что требуется совместная разработка механизма использования средств технического содействия для подготовки, в соответствии с требованиями ЕБРР, проектов, выдвигаемых в качестве приоритетных⁷ российской стороной. Более тесная координация между Россией, ЕБРР и ЕЭС (а ЕЭС через программу ТАСИС является основным донором⁸ предоставляемых в распоряжение Банка средств, а также одним из основных акционеров ЕБРР), способная привести к серьезным качественным сдвигам в этом важном направлении.

 

В заключение хочу подчеркнуть, что Российское правительство высоко оценивает роль ЕБРР в развитии российской экономики. Надеюсь на дальнейшее плодотворное сотрудничество.

While turning to our national endeavors to fight with drug abuse and its illicit trafficking, I would like to throw some light¹ on our recent initiatives. As you all know, Nepal is a small and peace-loving country which seeks to be declared “a zone of peace” as proposed by His Majesty the King in 1975. As such, peace is an overriding² concern for Nepal. We are neither prepared to jeopardize³ our social harmony nor let our young generation come under the grip of drug abuse⁴. His Majesty’s Government, therefore, has given top priority to eradicate the dangerous impact of drug abuse and its illicit trafficking and accordingly initiated a number of different measures and a series of national laws. The Narcotic Drugs Control Act of 1973 was amended in 1986 and in 1987 making the Act more effective and forceful. Provisions have been made for stiff penalties, up to 20 years in jail or 20 million Rs fine or both, for the offenders, and law enforcement has been considerably stepped-up⁵. Non-governmental organizations have also been encouraged to create public awareness of the ill-effects of drug abuse by conducting seminars, workshops, and meetings. Such efforts in our experience have proved beneficial.

Considering the dangerous impact and the serious threat posed by illicit trafficking of narcotic drugs, my delegation welcomes the convening of this conference at the plenipotentiary⁶ level. The challenge posed by drug trafficking is a common problem to be solved by common endeavors of us all. The success of this conference lies in our hands. We have to finalize and adopt the text of the convention against illicit trafficking of narcotic drugs and psychotropic substances. In our view the convention should be a supplementary to the Single Convention on Narcotic Drugs of 1961 as amended by the 1972 Protocol. Our efforts should be directed to make the convention as universal and acceptable to as many states as possible. Narcotic drug trafficking, in our opinion, is an international crime and the convention we are working for should be equipped with all the necessary provisions to deal with these crimes at their root.

 

Mr. President,

 

Finally I would like to assure you that my delegation will spare no efforts⁷ to contribute to bring the convention to a final shape.

Особенностью промышленного потенциала Нижегородской области является развитый машиностроительный комплекс⁶ (около 50% в общем объеме выпускаемой продукции) и уникальный научно-технический потенциал предприятий ВПК. За 2000 год предприятия машиностроения выпустили 52% российских грузовых автомобилей, 12% легковых, около 50% автобусов. К ведущим отраслям промышленности области также относятся черная металлургия⁷, химия и нефтехимия⁸, электроэнергетика, лесная⁹, деревообрабатывающая¹⁰ и целлюлозно-бумажная промышленность¹¹. Нижегородская область является крупнейшим транспортным регионом. Здесь создана высокоразвитая транспортная инфраструктура, а продление второго Европейского Транспортного коридора¹² до Н.Новгорода является новым стимулом для развития транспортной системы области на базе современных технологий транспортной логистики, включая сервисную составляющую.

 

Нижегородская область – развитый торговый регион. Торговля по доле в ВРП и занятости населения занимает второе место в экономике области и уступает лишь промышленности. 1. Ladies and Gentlemen, it is a pleasure to be here today in the Nizhny Novgorod region once again. And it is an honor to participate in this program.

 

To begin with, I want to thank the Virginia Polytechnic Institute and State University, and the Atlas Group for including me in the program.

 

It is a special pleasure to be here at the invitation of Academician Abel Agenbegyan.

 

In August 1991 I watched with interest a speech given by Academician Agenbegyan in California just after the unsuccessful putsch attempt. American television was then full of Russia programming. The Academician was speaking on the economy of the Soviet Union.

 

He said that there were optimists and there were pessimists. He said the optimists believed that things were so bad, they couldn’t get any worse. The pessimists disagreed. They believed things could get worse.

 

Today, both the optimists and the pessimists have reason to be happy. It appears – at least in the U.S. – things are getting better and worse at the same time. This is a phenomenon that contradicts the laws of economics, and perhaps even the laws of physics.

 

2. Which brings me to the question of physics. And in Nizhny Novgorod, which is a region and a city of physics and physicists, it is appropriate to speak of physics, especially radio physics.

 

What does a Philadelphia lawyer know about physics? Essentially, nothing. But, we have clients who deal in the real world and thus the world of physics. I shall discuss an example that illustrates that technology in laboratory may be far different in a court room or another legal setting.

 

My example is a dispute between the Philadelphia Orchestra and the Walt Disney Company concerning royalty payments for the home video motion picture version of “Fantasia”. At its center the case involved the physics of FM radio waves.

 

The lesson: however magnificent the creative abilities of the animation studio, the orchestra and the maestro, their understanding needs to be reduced to writing and is subject to legal principles and future interpretation. The Fantasia case shows that the parties may have different ideas about what they intended. When you negotiate a contract for transfer of technology or the use of intellectual property, you must keep in mind that one day a court may have to determine what the parties to a contract really intended.

 

In the years 1938 through 1940 the movie animation company Disney, the Philadelphia Orchestra and its conductor, Leopold Stokovski, collaborated in the creation of a unique feature animated motion picture entitled “Fantasia”.

 

3. At the time of the creation of “Fantasia”, the Philadelphia Orchestra was recognized as one of the three greatest symphonic orchestras in the United States.

 

Disney paid the Philadelphia Orchestra for the right to use the name and the musical performance of the Orchestra in “Fantasia” the total sum of $2,500.

 

In 1991 the Disney Company reissued “Fantasia” on video cassettes and laser discs for home television viewing. By December 31, 1991, Disney sold over 14 million units of “Fantasia” in North America alone, producing $220,000,000 in revenues and $120,000,000 in profits.

 

Despite the fact that Philadelphia Orchestra was a participant in “Fantasia”, Disney did not obtain its consent, and did not pay the Orchestra for the sale of the home videos.

 

4. The legal basis for the Orchestra’s work was a simple one page letter agreement dated January 11, 1939. In that letter, Disney, Stokovski and the Philadelphia Orchestra agreed to the following:

 

“The Philadelphia Orchestra Association agrees to furnish and grant to Leopold Stokovski and the Disney Studios the right to use the Philadelphia Orchestra for recordings in connection with this feature picture, said recordings to be made at the Academy of Music in Philadelphia…

 

“The Philadelphia Orchestra Association, Inc. further grants the right to Leopold Stokovski and the Disney Studios, in connection with this feature picture, to use the name “The Philadelphia Orchestra” on the screen and/or in all publicity and exploitation of said picture”.

 

The Philadelphia Orchestra performed and recorded the classical music that was used in “Fantasia” at the Academy of Music in Philadelphia in April 1939.

 

“Fantasia” was released in a feature-length theatrical motion picture format for exhibition in theatres outside the home in November 1940.

 

Disney promoted “Fantasia” as a “unique and innovative collaboration” of artistic and musical talents: “music you can see” and “pictures you can hear”.
