9. Termination of the Agreement 9.1. The termination of this Agreement shall be in effect in the following cases: 9.1.1. Completion of the Labour Agreement; 9.1.2. If the Employee’s actually stops fulfilling his labour functions; 9.2. The present Agreement may be terminated by the Employee under condition of the prior written notice given not later than 1 month before the date of the forthcoming termination. 9.3. The present Agreement may be terminated by the Employee without the prior written notice given: a) when the Vessel is ordered to proceed to the war zone as declared by Lloyds; b) when the Vessel does not meet the safety requirements. c) when the Vessel is otherwise illegally sails. 9.4 The present Agreement may be terminated by the Employer: a) when the Vessel becomes total loss; b) when the Vessel is laid-up for the period exceeding 1 month; c) when the Vessel is sold; d) when the Vessel is under arrest; e) when the Employee is in breach of Labour Discipline under condition of prior written notice given not less than 1 day before the date of the forthcoming termination; f) In other cases expressly indicated in the Agreement. 9.4. The present Agreement may be terminated by the Employer: a) when the Vessel becomes total loss; b) when the Vessel is laid-up for the period exceeding 1 month; c) when the Vessel is sold; d) when the Vessel is under arrest; e) when the Employee is in breach of Labour Discipline under condition of prior written notice given not less than 1 day before the date of the forthcoming termination; f) In other cases expressly indicated in the Agreement. 9.5. When this Agreement is terminated by the Employee without preliminary notice in accordance with sub-clause 9.2, the Employee shall have to pay repatriation expenses as well as the expenses borne by the Company for the arranging of the Employee replacement. 9.6. When this Agreement is terminated by Employer the Employer shall have to pay the Employee compensation equal to the wage rate in all cases excluding the cases when such termination is caused by the Employee’s fault. 10. Repatriation 10.1. Repatriation of the Employee to the place of permanent living shall be for the account of the Employer regardless of the reasons for termination of this Agreement. 10.2. Repatriation of the Employee shall be performed in economy class by air, sleeping car by railway or intercity motor transport. The Employer shall ensure the Employee the most comfortable conditions of transportation under repatriation. 11. Miscellaneous 11.1. All and any legal relationship arising out of the present Agreement but not provided for hereby shall be governed by and in accordance with the legislation of the Republic of Cyprus. 11.2. All disputes and differences arising out of this Agreement shall be settled in accordance with the laws of the Republic of Cyprus. Experience & Qualifications required: · more than five years experience in similar Projects; · previous experience of running large fleets essential; · practical experience of large vehicles would be an advantage; · off-road driving techniques desirable; · be able to adapt and communicate with drivers of different educational levels and form a team; · overseas experience, with remote and difficult terrain experience; · previous experience of Shell or Russian Projects would be advantageous; · high standard of education including written and spoken English language; · sound knowledge of all transport related issues including the carriage of dangerous goods; and · holder of both International and National CPC Certificates in Professional Competence.
