The monography is devoted to research of the jurisdiction of the Court of Justice of the European Union and the forms ofits realization such as proceedings and judgments. The research helps to understand the status of the Court in the in­stitutional system of the European Union and its role in the development of the supranational law.

Dynamic of the foundation and development of institutional system of the European Union is one of the main features of this system which helps to adapt for changes and to overcome institutional crisis of the organization. This feature is also inherent to the Court of Justice of the European Union. Despite the fact that the Court of Justice of the European Union is a judicial organ of the international or­ganization, the characteristic ofits activity gives the author possibility to talk about the evolution ofits status during the development of the European Communities and the European Union (EU). Undoubtedly the Court of Justice of the EU is the court of international organization but with specific features which consist in com­bination of features of the international and at the same time of national judicial organs. Such plurality of features exists because oflarge quantity of functions which the Court executes. The author underlines that the Court of Justice of the EU ex­ecutes functions ofinternational, federal (supreme), constitutional and administra­tive court.

In the monography the author investigates the process of establishment and transformation of competencies of EU institutions together with genesis of the Court's jurisdiction. This helps to understand that the Court of Justice of the EU had played a great role in the development of the institutional balance inside the EU. Jurisdiction of the Court has fundamental value and is an instrument of har­monization of the institutes' competencies. Moreover the Court's jurisdiction defines not only the measures of competencies but provides the realization of fundamental principles of the EU legal system such as principles of proportionality, institu­tional balance, supremacy and direct effect of supranational law.

Important conclusion is that in the legal system of the EU there is a certain stan­dard oflegal protection. The components ofthis standard are competencies of all the EU institutions. But of course the main component of standard oflegal protection is the jurisdiction of the Court of Justice of the EU. For example, uniqueness of the realization of the EU law in the enforcement proceeding against Member-State for failing to fulfil its duties under Art. 258-260 of the Treaty on the functioning of the EU is in combined powers of the Commission of the EU and the Court of Justice of the European Union. Such combination of powers gives wide opportunities for better development ofthe EU law and of the European integration.

The important issue ofthe monography is that through the judicial revising of the legality ofthe EU measures (acts) (Art. 263 ofthe Treaty on the functioning of the EU) the principle ofthe supremacy ofthe EU law is gained. This procedure establishes remedies against the abusing of powers by the EU intuitions and organs. The procedure under Art. 263 is really unique because in international law and in

national legal systems the situation when private persons can plead before judicial organs on appeal of legal acts is revolutionary. This once more underlines the spe­cific legal nature of the EU.

Great attention in monography is paid to the preliminary ruling proceeding under Art. 267 of the Treaty on the functioning of the EU. It became a cornerstone of the existing legal system of the EU. The preliminary ruling proceeding - it is a procedural form in which such fundamental principles as principle of direct effect, supremacy of the EU law and the states' responsibility are developed. In this con­text the author proposes the ways of protection of private persons' interests in the Court of Justice of the EU.

The author underlines that the Court of Justice of the EU develops the legal order of the European Union by producing its decisions which are the main proce­dural form of realization of Court's jurisdiction. The nature of decisions of the Court of Justice of the EU is defined as "quasi precedent" because of the importance of its using but without binding force.

The monography pays attention to such process as constitutionalization of the EU law in which the Court of Justice ofthe EU plays a vital role. Constitutionaliza­tion means that the EU law has force not only for member States but also for private (physical and legal) persons, which are under the jurisdiction ofthe Member States. This gives the possibility to use the EU law directly in national legal systems and before national courts. In this context non application ofthe stare decisis doctrine to the activity ofthe Court becomes a positive moment for the Court because of making the Court flexible in its interpretative work which sometimes becomes law-making.

Legal mechanisms ofthe cooperation between the Court of Justice ofthe EU and national courts are examined. Interaction of these two levels of judicial organs - is a phenomenon ofthe European integration. There is both-side influence of such two levels of judicial organs. In this way in different spheres of legal regulations occurs "gibridization" of law. As research showed, we can talk about the develop­ment of different transnational legal norms, for example, about European civil process which became a separate subject of studying by author.

The author proves that the activity ofthe Court of Justice ofthe EU directed to the development of mechanisms of protection of private persons. In this context the author proposes the ways of such protection in the Court of Justice ofthe EU.

The monography is based on the case law ofthe Court of Justice ofthe EU, General Court, the EU Civil Service Tribunal and of the national courts of EU Member-States. In the monography all novels ofthe Lisbon Treaty, which entered into force on 1 December 2009 is considered.

The monography is for scientists, lecturers, PhD-researchers and lawyers.
