ПРАКТИЧЕСКИЕ ЗАДАНИЯ Вариант № 1 Упр. 1. Сделайте письменный перевод следующего текста: Text 1 Litigation (1) If a dispute is not settled by agreement between the disputing parties, it will eventually be heard and decided by a judge and/or jury in a court. A lawsuit before a court is commonly referred to as litigation. In fact, litigation includes all stages before, during and after a trial. (2) Litigation may be used to resolve a dispute between private individual, an individual and a business, or between two businesses. Litigation sometimes involves disputes between an individual or business and a government agency, or between two governmental bodies. (3) In the UK, the majority of pre-trial work is carried out by a solicitor before the case is passed on to a barrister, who will represent either the claimant or the defendant during a hearing or a trial. In the USA, the same attorney may deal with the case from the time the client first makes contract through to the trial and enforcement stages. The steps in between these two stages typically include an attempt to reach a settlement before and/or after filing a lawsuit and pleadings, entering the discovery phase and then proceeding to trial. At the end of a trial, the court will deliver its judgment and pass an order, which the winning party’s counsel and/or the court may help the winning party to enforce. (4) Criminal matters are also considered litigation, and many civil litigation lawyers also deal with criminal cases, as well as some forms of alternative dispute resolution (ADR) such as negotiation, arbitration and mediation. Сделайте письменный перевод следующего текста: Text 1 Civil and Criminal Cases Both civil and criminal courts in England and Wales hear evidence and determine what exactly happened in a case. Broadly speaking, the lower courts decide matters of fact and the upper courts normally deal with points of law. In England, simple civil actions, for example, family matters such as an undefended divorce, are normally heard either in the Magistrates’ Courts or the County Courts. Judges have different titles depending on their experience, training, and level. A single stipendiary magistrate or three lay magistrates sit in the Magistrates’ Court. There is no jury in a Magistrates’ Court. The County Court also hears complex civil cases, such as contract disputes, compensation claims, consumer complaints about faulty goods or services, and bankruptcy cases. In England and Wales the Magistrates’ Courts try about 95% of all criminal cases, which are petty crimes, that is, less serious ones. In certain circumstances, the court may commit an accused person to the Crown Court for more severe punishment, either by way of a fine or imprisonment. The Crown Court tries more serious offences such as theft, assault, drug dealing, and murder. In almost all criminal cases, the State, in the name of the Crown, prosecutes a person alleged to have committed a crime. In England and Wales, a jury of twelve people decides whether the defendant is guilty of the crime. Youth courts are similar to adult magistrates’ courts but they deal with offenders aged between 10 and 17 inclusive. Youth courts are presided over by specially trained experienced adult magistrates or a district judge. Youth courts are not open to the public for observation, only the parties involved in a case being admitted. I. Фонетические упражнения Упр. 2. Text II History of Court Dress The costume of a High Court judge, for example – a long robe, a full hood with a cowl covering the shoulders and a mantle (or cloak) – was more or less established by the time of Edward III (1327−77) and was based on the correct dress for attending the royal court. The material for these robes was originally given to judges as a grant from the Crown, and included ermine and taffeta or silk. The colours were violet for winter and green in summer, with scarlet for best, but the last mention of green robes dates back to 1534. In 1635 the definitive guide to court dress was published in the Judges’ Rules. But this didn’t introduce new costumes; it just set out what existing robes should be worn, and when. So after 1635, the correctly-dressed judge would have worn a black robe faced with miniver (a light-coloured fur) in winter, and violet or scarlet robes, faced with shot-pink taffeta, in summer. A black girdle, or cincture, was worn with all robes. A less formal version of the robes – a scarlet robe, black scarf and scarlet casting-hood (also known as a tippet or stole) – was used for criminal trials, and for civil trials some judges had begun to wear a black silk gown. Plain linen bands began to be worn at the neck, in place of the ruffs associated with Queen Elizabeth I. These were originally wide collars, but by the 1680s had become what we see today: two rectangles of linen, tied at the throat. Bands are still usually worn with a winged collar, rather than the turn-down collar seen on a typical shirt today. Until the seventeenth century, lawyers were expected to appear in court with clean, short hair and beards. Wigs made their first appearance in a courtroom purely and simply because that’s what was being worn outside it; the reign of Charles II (1660−1685) made wigs essential wear for polite society.
