Розслідуванню підлягають поранення, травми, у тому числі отримані внаслідок тілесних ушкоджень, заподіяних іншою
person, sharp professional diseases and sharp professional and other poisoning, thermoplegias, burns, frostbites, drowning, hitting by electric current, lightning and ionizing radiation, other damages, caused by failures, conflagrations (fires), disasters like earthquakes, slides, floods, hurricanes and other extraordinary events, contacts with animals, insects and other representatives of fauna and flora, that caused the capacity loss of the worker on one workday or more, or the necessity to round the victim on other more easier work not less than for one workday, and also the cases of death on enterprise.The cases belong to sharp professional diseases and sharp professional poisoning if they happened due to non-permanent influence of dangerous factors or harmful matters, during no more than one work day. The sharp professional diseases are caused by action of chemical matters, ionizing and unionizing radiation, considerable physical loading and overstrain of separate organs and human body systems. The sharp professional poisoning are caused mainly by harmful matters of direct impact. To them belong also the infectious, parasite, allergic diseases, etc. An employer, after obtaining the report on accident, will organize its investigation, for what he forms the investigation commission.

The commission consist of: the head of the labour precaution or the official on which the precaution functions had been put by the employer - he is a chairman of this commission; the head of structural subdivision, the representative of the trade-union organization which member is the victim, or the representative of work team on problems of labour precaution, if the victim is not a member of trade union, witnesses, technical experts.

особою, гострі професійні захворювання і гострі професійні та інші отруєння, теплові удари, опіки, обмороження, утоплення, ураження електричним струмом, блискавкою та іонізуючим випромінюванням, інші ушкодження, отримані внаслідок аварій, пожеж, стихійного лиха – землетруси, зсуви, повені, урагани та інші надзвичайні події, контакту з тваринами, комахами та іншими представниками фауни і флори, що призвели до втрати працівником працездатності на один робочий день чи більше або до необхідності переведення потерпілого на іншу – легшу роботу терміном не менш як на один робочий день, а також випадки смерті на підприємстві.До гострих професійних захворювань і гострих професійних отруєнь належать випадки, що сталися після одноразового, протягом не більше однієї робочої зміни, впливу небезпечних факторів, шкідливих речовин. Гострі професійні захворювання спричиняються дією хімічних речовин, іонізуючого та неіонізуючого випромінювання, значним фізичним навантаженням та перенапруженням окремих органів і систем людини. Гострі професійні отруєння спричиняються в основному шкідливими речовинами гостроспрямованої дії. До них належать також інфекційні, паразитарні, алергійні захворювання тощо. Роботодавець, одержавши повідомлення про нещасний випадок, організує його розслідування, для чого утворює комісію з розслідування.Комісія: керівник служби охорони праці або посадова особа, на яку роботодавцем покладено виконання функцій спеціаліста з питань охорони праці - він голова цієї комісії, керівник структурного підрозділу, представник профспілкової організації, членом якої є потерпілий, або уповноважений трудового колективу з питань охорони праці, якщо потерпілий не є членом профспілки, свідки, технічні експерти.

The structure of the commission on investigation does not include the boss, which is directly responsible for labour precaution on a place where there an accident happened.

If accident was happened with person, which provides oneself by work independently, investigation will organized by suitable work organ of executive fund directorate and then by a head of investigation commission is elaborated from this suitable work organ of executive directorate of the Fund. During three days an investigation commission is beholden: - to inspect a site of the accident, to interrogate the witnesses and persons, which are participial to it, to obtain explanation of victim, if it is possible;- to define accordance of the conditions and safety of work to demands of normatively-legal acts on labour precaution; - to clear up the circumstances and causes of the accident, to define, associated or not this case with production;- to define the persons, which admitted violation of legislation on labour precaution, and also to develop arrangements for prevention of the similar accidents in future;- to draw up a report (statement) on accident investigation in Н-5 form in two copies, and also an act in Н-1 form or act in НТ form about victim of the accident in six copies and to hand down it on adoption to employer.If sharp professional diseases (poisoning) has happened except the act of Н-1 form map of professional disease (poisoning) is composed also in form П-5.In accounting with conclusions of the investigation commission of an accident is recognized as associated with production and an act in Н-1 form is drawn up about these accidents, that happened with workers under execution of laboured duties (in work time), including also during business trips, as well as that happened in time of:До складу комісії з розслідування не включається керівник робіт, який безпосередньо відповідає за охорону праці на місці, де стався нещасний випадок.У разі настання нещасного випадку з особою, яка забезпечує себе роботою самостійно, розслідування організує відповідний робочий орган виконавчої дирекції Фонду і тоді головою комісії з розслідування призначається представник відповідного робочого органу виконавчої дирекції Фонду.

Протягом трьох діб комісія з розслідування зобов'язана:

- обстежити місце нещасного випадку, опитати свідків і осіб, які причетні до нього, та одержати пояснення потерпілого, якщо це можливо;

- визначити відповідність умов і безпеки праці вимогам нормативно-правових актів про охорону праці;

- з'ясувати обставини і причини, що призвели до нещасного випадку, визначити, пов'язаний чи не пов'язаний цей випадок з виробництвом;

- визначити осіб, які допустили порушення нормативно-правових актів про охорону праці, а також розробити заходи щодо запобігання подібним нещасним випадкам;

- скласти акт розслідування нещасного випадку за формою Н-5 у двох примірниках, а також акт за формою Н-1 або акт за формою НТ про потерпілого у шести примірниках і передати його на затвердження роботодавцю.

Якщо виникли гострі професійні захворювання (отруєння) крім акта за формою Н-1 складається також карта обліку професійного захворювання (отруєння) за формою П-5.

За висновками роботи комісії з розслідування нещасні випадки визнаються пов'язаними з виробництвом і складається акт за формою Н-1 про ці нещасні випадки, що сталися з працівниками під час виконання трудових обов'язків, у тому числі у відрядженнях, а також ті, що сталися під час:

a) being at work place, on enterprise territory or elsewhere at work during work time, or by order of employer in non-working time, during vacation, weekend and holidays;b) when a worker is ordering the production tools, protection means, clothes before the beginning of work and after its finishing, and also during arrangements of personal hygiene;c) journey to work or from work by using enterprise transport mean or transport mean of other enterprise, which allotted it in accordance to contract, in presence of employer order; d) use of own transport mean on behalf of enterprise, on permission or by order of employer according to established form;e) of actions on behalf of enterprise, where a victim works, actions, which do not enter to circle of production task or direct duties of the worker, for example, assignment of necessary help to other worker, action for warning of possible failures or rescuing of peoples and enterprise property, other actions in presence of employer order etc;f) liquidation of failures, conflagrations and outcomes of accidents at production objects and transport means, that are used on enterprise;g) assignment by enterprise of patronage help;h) being in transport mean or at its parking place, on territory of the watch settlement, also including during rest-time of the change, if accident cause was associated with execution by victim of laboured (official) duties or with impact on him of dangerous or harmful production factors or environment;i) being in trip to place of business and at return according with task of business trip.

 

а) перебування на робочому місці, на території підприємства або в іншому місці роботи протягом робочого часу, або за дорученням роботодавця в неробочий час, під час відпустки, у вихідні та святкові дні;

б) коли робітник приводить в порядок знаряддя виробництва, засоби захисту, одягу перед початком роботи і після її закінчення, а також при виконанні заходів особистої гігієни;

в) проїзду на роботу чи з роботи на транспортному засобі підприємства або на транспортному засобі іншого підприємства, яке надало його згідно з договором (заявкою), за наявності розпорядження роботодавця;

г) використання власного транспортного засобу в інтересах підприємства, з дозволу або за дорученням роботодавця відповідно до встановленого порядку;

д) провадження дій в інтересах підприємства, на якому працює потерпілий, тобто дій, які не входять до кола виробничого завдання чи прямих обов'язків працівника, наприклад, надання необхідної допомоги іншому працівникові, дії щодо попередження можливих аварій або рятування людей та майна підприємства, інші дії за наявності розпорядження роботодавця тощо;

е) ліквідації аварій, пожеж та наслідків стихійного лиха на виробничих об'єктах і транспортних засобах, що використовуються підприємством;

ж) надання підприємством шефської допомоги;

з) перебування на транспортному засобі або на його стоянці, на території вахтового селища, у тому числі під час змінного відпочинку, якщо причина нещасного випадку пов'язана з виконанням потерпілим трудових (посадових) обов'язків або з дією на нього небезпечних чи шкідливих виробничих факторів або середовища;

к) прямування до місця відрядження та в зворотному напрямку відповідно до завдання про відрядження.

Accidents are defined as associated with production and a statement of form Н-1 is drawn up also with the cases:- natural death of the workers under staying and using underground works (extraction of natural resources, building, reconstruction, technical retooling and big repair of mines, underground (metro), underground channels, tunnels and other underground constructions, geological survey works, which are carrying out under the ground) or during four hours after going out on surface by reason of sharp cardiac-vascular insufficiency;- suicides among the float staff on boats of sea and fishing fleet;- disappearance of worker in time of laboured (official) duties; - associated with infliction of body damages by other person, or worker murder in time or in tie with execution by him of laboured (official) duties, irrespectively to violation of criminal affairs, excluding the cases of clearing up by victim of personal problems, if a conclusion of competent organs exists on the subject of these actions;- had happened by reason of sudden worsening of worker health state, because of influence of dangerous or harmful production factors or if victim does not go over medical examination, that is foreseen by legislation, and work, that was fulfilled, was contra-indicated to victim according to medical conclusion about state of his health.- that had happened with workers on enterprise territory or elsewhere at work during interruption time for rest and food, which is set in accordance with internal labour rules, and also in time of workers staying at enterprise in tie with taking by employer of conference, receipt of salary, obligatory passing of medical examination, etc, and also in cases, foreseen by collective agreement.

 

Нещасні випадки визначаються пов'язаними з виробництвом і складається акт за формою Н-1 також про випадки:

- природної смерті працівників під час перебування і використання підземних робот (видобування корисних копалин, будівництво, реконструкція, технічне переоснащення і капітальний ремонт шахт, рудників, копалень, метрополітенів, підземних каналів, тунелів та інших підземних споруд, геологорозвідувальні роботи, які проводяться під землею) або протягом чотирьох годин після виходу на поверхню внаслідок гострої серцево-судинної недостатності;

- самогубства працівників плавскладу на суднах морського та рибопромислового флоту;

- зникнення працівника під час виконання трудових (посадових) обов’язків;

- пов'язані із заподіянням тілесних ушкоджень іншою особою, або вбивство працівника під час виконання чи у зв'язку з виконанням ним трудових (посадових) обов'язків незалежно від порушення кримінальної справи крім випадків з'ясування потерпілим особистих стосунків, якщо з приводу цих дій є висновок компетентних органів;

- що сталися внаслідок раптового погіршення стану здоров'я працівника, із-за впливу небезпечних чи шкідливих виробничих факторів або якщо потерпілий не проходив медичного огляду, передбаченого законодавством, а робота, що виконувалась, була протипоказана потерпілому відповідно до медичного висновку про стан його здоров'я.

- що сталися з працівниками на території підприємства або в іншому місці роботи під час перерви для відпочинку та харчування, яка встановлюється згідно з правилами внутрішнього трудового розпорядку, а також під час перебування працівників на території підприємства у зв'язку з проведенням роботодавцем наради, отриманням заробітної плати, обов'язковим проходженням медичного огляду тощо, а також у випадках, передбачених колективним договором.

Such accidents are counted as associated with productionand a statement of form Н-1 is drawn up on them.In accordance with conclusions of investigation commission the accidents are not disallowed as associated with production and a statement of form Н-1 is not drawn up, if they have happened with workers:- in time of going on work or from work on foot, using own, public or other transport mean, which does not belong to enterprise and does not used on behalf of this enterprise;- at place of permanent inhabitation on the territory of field and watch settlements;    - in time of use by workers for personal aims of enterprise transport means without employer permission, and also equipment, mechanisms, instruments, excluding the cases, that happened by reason of disrepair of this equipment, mechanisms, instruments;    - as outcome of poisoning by alcohol, narcotic or other poisonous matters, and also as circumstances of their action (asphyxia, cerebral thrombosis, heart stop, etc) in presence of medical conclusion, if this not caused by application of these matters in production processes or violation of safety demands as for their keeping and transport, or if victim, which was in state of alcoholic or narcotic intoxication, was suspended from work according with established order;

- in time of crimes fulfilled by them or other illegal actions, if they are confirmed by decision of law-court.

Statement in form НТ (unproductive traumatism) is drawn up about such accidents.

 

Такі нещасні випадки визнаються пов'язаними з виробництвом і про них складається акт за формою Н-1.

За висновками роботи комісії з розслідування невизнаються пов'язаними з виробництвом і не складається акт за формою Н-1 про нещасні випадки, що сталися з працівниками:

- під час прямування на роботу чи з роботи пішки, на громадському, власному або іншому транспортному засобі, який не належить підприємству і не використовувався в інтересах цього підприємства;

за місцем постійного проживання на території польових і вахтових селищ;

під час використання працівниками в особистих цілях транспортних засобів підприємства без дозволу роботодавця, а також устаткування, механізмів, інструментів, крім випадків, що сталися внаслідок несправності цього устаткування, механізмів, інструментів;

- у наслідок отруєння алкоголем, наркотичними або іншими отруйними речовинами, а також унаслідок їх дії (асфіксія, інсульт, зупинка серця тощо) за наявності медичного висновку, якщо це не викликано застосуванням цих речовин у виробничих процесах або порушенням вимог безпеки щодо їх зберігання і транспортування, або якщо потерпілий, який перебував у стані алкогольного чи наркотичного сп'яніння, був відсторонений від роботи згідно з установленим порядком;

- під час скоєння ними злочинів або інших правопорушень, якщо ці дії підтверджені рішенням суду.

Про такі нещасні випадки складається акт за формою НТ - невиробничий травматизм.
1.2. Reporting on accidents, their investigation and record maintaining If accident has happened then witness, a worker, which expressed it, or victim himself ought to communicate immediately to works, leader or other representative person of the enterprise and to take measures for assignment of necessary help. In turn a works` leader is obliged:- to organize urgently an assignment of medical aim to victim, in necessity to get him to medically-prophylactic establishment at once;- to report an employer and suitable trade-union organization about what has happened;- to keep before the arrival of investigation commission a work place and equipment in such state, in which they were at moment of event if this does not threaten to life and to health of other workers and will not give rise to more terrible outcomes, and also to take measures to prevent from similar events.Employer, after receiving the accident announcement, excluding the cases with mortal outcome and grouping cases:- reports on accident to a suitable work organ of executive directorate of Fund in form, that was set by this Fund,- organizes its investigation and establishes an investigation commission.Accidents, about which acts were composed in form Н-1 or НТ, are taken into account and registered by employer in special book.The acts in form Н-1 or НТ are affirmed during 1 day after finishing of investigation and during three days must be sent:
