Divestiture or Disqualification
Definition An appropriate authority according to ISKCON Law can order the divestiture (disqualification) of a devotee for his performance of specified activities in any one of following categories: 1. Right to initiate by an ISKCON guru 2. Priestly functions (worshipping the deity, performing fire yajña, etc.) 3. Managerial authority (Temple President, Regional Secretary, GBC Member, Temple Board Member, Department Head, gurukula teacher) 4. Preaching responsibilities (authority to give temple classes, public speaking and other preaching on behalf of ISKCON) Divesting Authority Generally the authority who invested, or given the authority can also divest, the devotee unless otherwise provided for in ISKCON Law. Dissociation Dissociation is an order which restricts, excludes or prohibits the association and participation in ISKCON to one of the following degrees: 1. Prohibited from being a dependent ISKCON (temple) devotee. 2. Prohibited from living in a ISKCON community 3. Prohibited from being an active temple or congregation member but can visit as a guest. Reasons for Discipline
Depending on the severity of any improper activity, corrective steps may consist of informal discussions, written warnings or censures, disciplinary measures such as placing the offending participant on probation or suspension, or permanent prohibitions against future participation, or any other measures deemed appropriate to the situation by the GBC. Disciplining Authority Censure When ordering the censure, the disciplining authority must clearly set forth in writing to the disciplined person the specific actions that were irresponsible, inappropriate, or in violation of ISKCON Law and why they were judged so. Probation
At the end of the period of probation, the disciplining authority must decide one of the following:
Suspension Pending Investigation Suspension pending investigation is to separate a person from ISKCON activities so that a thorough investigation of allegations may be conducted and the suitability of the person to participate is determined. The disciplining body must conduct an immediate investigation so as to minimize disruption. After completion of the investigation, the body shall make a determination as to the truth of the allegations and the future course of action as per one of the following:
Suspension When ordering the suspension, the disciplining authority must clearly set forth in writing to the disciplined person:
Suspension of the right to participate is not limited by time, but shall remain in effect until specifically withdrawn by the disciplining or any higher authority. Excommunication
If the GBC Body determines that a person shall be excommunicated from the activities of the entire society then the GBC Secretary shall issue a “â?œNotice of Non-participation” â? barring the former participant from participation in all ISKCON activities. Appeals If an ISKCON participant has his/her participation restricted by the action of a Zonal Secretary or Divisional or National Council, he/she shall have the right of appeal to the Regional Governing Body (if one exists in the area) or the GBC Body (if there is no Regional Governing Body in the area). If he or she has his/her participation restricted by the action of a Regional Governing Body, he/she shall have the right of appeal to the GBC Body. If he or she has his/her participation restricted by the action of the GBC Executive Committee, he/she shall have the right of appeal to the GBC Body. Any disciplinary action taken against an ISKCON participant by any of the above-mentioned entities shall stand unless and until it is overruled by a higher body.
Expulsion (Excommunication) 1. Some members of the Society who have previously been in good standing have subsequently deviated from the ISKCON standard and whereas such members by their bad conduct and character may damage the good name of the Society. In such cases, the GBC Body may, by a two third(2/3) vote of the members present expel any member of the ISKCON provided that: a. The member is openly deviating from the fundamental tenants of the Society's teaching. b. The member is openly and flagrantly antagonistic to the GBC or other ISKCON authority. c. The member is engaged in illegal activities.
8.4.7.1 Conditions of
1.The GBC is the ultimate managerial authority for ISKCON 2. They accept His Divine Grace A.C. Bhaktivedanta Swami Prabhupada, Founder-Acarya of ISKCON, as the preeminent siksa guru for ISKCON. However, if there are any special circumstances surrounding that devotee’s departure then a procedure of reinstatement may be required. 8.4.7.2 Procedure of Reinstatement
1. the devotee desiring to return shall send a signed letter to GBC Corresponding Secretary stating his agreement to the above-listed provisions (8.4.7.1).
2. The GBC Corresponding Secretary shall send the letter to all GBC members. If no objections are received by the Corresponding Secretary within 90 days of the date of distribution to all members, then the Corresponding Secretary shall send a notice of reinstatement to the devotee in question along with all GBC members.
Notwithstanding the above, in the following cases reinstatement may only be granted by simple majority vote of the full GBC Body:
5. Devotees for whom a written objection from a GBC member has been submitted to the Corresponding Secretary within 90 days of notification, as per above.
2. In an extreme case, the GBC, by a two third(2/3) vote of the members present may issue a notice of non-participation. If such a notice is issued against an expelled member, such member shall not, in so far as possible, be allowed to participate in the functions of ISKCON. This law shall run concurrently with other disciplinary laws.(83) 3. The GBC has been designated by Srila Prabhupada as the highest ISKCON authority, and the final appellate power rests with that body in all ISKCON affairs.(79) Someone who is excommunicated is prohibited from visiting the temple except expressly allowed to visit as a guest by the local authority. ISKCON devotees should avoid association with an excommunicated person except when authorized to preach to him for his rectification.
